Terms and Conditions of Service

1. Introduction

Please read these Terms and Conditions carefully before placing an order on our website. By doing so, you agree to be bound by these terms.

2. Interpretation

“We”, “us” or “our” refers to Ernest Doe & Sons Ltd.
“You” or “your” refers to the customer placing an order through our online store.

3. Order Process

The display of products and pricing on our website is an invitation to treat and not a binding offer. By submitting an order, you are making an offer to purchase products under these terms.

How it works:

  1. Add your chosen items to the basket and proceed to checkout.
  2. Create an account or log in if you’re an existing customer.
  3. Select delivery method and accept these Terms of Sale.
  4. You’ll be redirected to a secure payment service (e.g. Barclaycard).
  5. An automated email will confirm we’ve received your order — this is not acceptance.
  6. A contract is only formed when we send a separate order confirmation email after reviewing product availability and pricing.

We reserve the right to cancel or refuse orders before the contract is formed, particularly in the event of pricing errors, stock issues, or technical faults (including system glitches).

If a product was listed at an incorrect price or offered in error and your order has not yet been confirmed by us, we are not obliged to fulfil it. If we identify such an error, we will contact you with the option to pay the correct price or cancel the order.

4. Products

Our online range includes (but is not limited to) clothing, footwear, gardening accessories, garden machinery, tools, toys, and portable gas heaters. Availability and specifications may vary.

5. Price and Payment

All prices include VAT where applicable. Delivery charges are shown at checkout. Prices may change but will not affect confirmed orders.

Payment is required in full at the time of order. We accept payments via Barclaycard or any other secure payment methods listed on the website.

Pricing Errors

In the event of a pricing error, we reserve the right to cancel any affected orders. If we contact you with the correct price, you may choose to proceed or cancel.

Unjustified Chargebacks

If you raise an unjustified chargeback, you will be liable for:

  • The chargeback amount
  • Associated third-party fees
  • An admin fee of £10 (inc. VAT)
  • Any recovery costs (e.g. legal or collection fees)

6. Your Warranties

You confirm that:

  • You are legally capable of entering into a binding contract
  • The order details you provide are complete and accurate
  • You are at least 18 years old and reside in England or Wales
  • You can accept delivery at the specified address

7. Delivery Policy

Products will be delivered to the address you provide at checkout. While we aim to deliver within 7 days, we guarantee dispatch within 30 days unless otherwise agreed.

Where possible, please inspect your order upon delivery. If damaged, note this on the delivery note or write “not checked”. Please report any damage within 7 days by calling 01245 383565 or emailing enquiry@ernestdoe.com.

8. Risk and Ownership

Risk transfers to you upon delivery. Ownership transfers only once we have received full cleared payment.

9. Right to Cancel and Returns

You have the right to return goods purchased from our website within 21 days of receipt, provided they are unused, in resalable condition, and returned in their original packaging.

This return period complies with and extends the statutory minimum cancellation period under the Consumer Contracts Regulations 2013.

To request a return:

  • Notify us in writing within 21 days of receiving your goods
  • Return the items promptly and at your own cost unless the item is faulty
  • Items must be securely packaged and in their original condition

Exclusions

You will not be entitled to cancel, return, or receive a refund for:

  • E-gift cards – these are non-refundable and non-cancellable. By purchasing an e-gift card, you agree to waive your right to cancel under Regulation 28(1)(b) of the Consumer Contracts Regulations.

A full refund (including standard delivery where applicable) will be issued for eligible returns.

10. Title of Goods

Legal title remains with us until full payment has been received.

11. Statutory Rights

These terms do not affect your legal rights under UK consumer law, including rights relating to faulty or misdescribed goods.

12. Refunds

Refunds for valid returns will be:

  • Issued to your original payment method
  • Processed by us within 7 days of receiving the returned item(s)
  • Subject to a total refund window of up to 14 days, allowing time for external bank processing or transaction delays beyond our control

13. Limitations of Liability

We do not exclude liability for death, personal injury caused by negligence, or any liability that cannot be excluded by law.

We are not liable for:

  • Events outside our control
  • Business-related losses (e.g. profit, revenue, goodwill)

14. General Terms

  • Your personal data is handled in accordance with our Privacy Policy.
  • Website use is governed by our Website Terms of Use.
  • We may revise these terms from time to time, but changes won’t apply to existing contracts.
  • Contracts are governed by English law. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
  • If any provision is deemed unenforceable, the remaining provisions remain in effect.
  • You may not transfer your rights under this contract. We may do so, provided your rights are not affected.

16. Online Discount Codes

From time to time, we may offer discount codes for use on our webshop only. These offers may apply to specific products or ranges, and are subject to change.

Discount codes:

  • Must be entered at checkout before completing your order
  • Cannot be used in-store
  • Cannot be applied retrospectively to previous or completed orders
  • May exclude certain products, brands, clearance items, or equipment (e.g. Atco, ride-on mowers, compact tractors)
  • Cannot be exchanged for cash or combined with other offers
